Cox and Mazzoli Win Supreme Court Appeal

Cox and Mazzoli Win Supreme Court Appeal

A Jefferson Circuit Court jury awarded our client $4,174,630.28 in compensatory damages for injuries she sustained in a bus accident. The trial court refused to permit argument to the jury about the issue of punitive damages. We appealed that ruling to the Kentucky Court of Appeals and the bus company appealed the judgment. Our client won in a unanimous opinion on appeal. The bus company then appealed to the Kentucky Supreme Court. In another unanimous opinion, the Supreme Court affirmed the Court of Appeals on all issues. The case will now be remanded to Louisville for a retrial only on the issue of punitive damages. See, MV Transportation, Inc. v. Allgeier, 2012-SC-000462-DG.

This was one of the largest jury verdicts awarded by a Louisville jury in the last several years.
