Determining the Sentencing Guideline Range in Federal Fraud Cases

The Sixth Circuit recently reaffirmed in the Agrawal case (10-26-23) that defendants are entitled to a reduction in the fraud guidelines for the value that was provided to a victim even when fraud is involved. 

The Sentencing Guidelines are substantially determined by quantity. This is true in drug cases and in fraud or theft matters.  The Sixth Circuit held once again that the credit-against-loss rule is still alive and well in this circuit.  Defendants should retain experienced federal criminal defense attorneys who keep current on all recent developments.  Our ability to persuade the sentencing judge to apply this loss rule has caused significant reductions in our clients' sentences.
