There have been numerous changes in the Federal Sentencing Guidelines that may affect defendants in drug cases both positively and potentially harmfully. For instance, 18 U.S.C. §3582(c)(2) permits defendants in cases where the sentencing range has subsequently been lowered by the Sentencing Commission to petition the trial court to reduce their initial sentence. Drug laws in the Commonwealth have also been modified recently to carry different sentences depending on the quantity of marijuana, cocaine, heroin or methamphetamine that a defendant can be held responsible for.
