Drug Lawyers Must Stay Alert to Changes in Federal and State Drug Laws

There have been numerous changes in the Federal Sentencing Guidelines that may affect defendants in drug cases both positively and potentially harmfully.  For instance, 18 U.S.C. §3582(c)(2) permits defendants in cases where the sentencing range has subsequently been lowered by the Sentencing Commission to petition the trial court to reduce their initial sentence.  Our firm is now reviewing cases to determine where these motions should be filed. Drug laws in the Commonwealth have also been modified recently to carry different sentences depending on the quantity of marijuana, cocaine, heroin or methamphetamine that a defendant can be held responsible for.

It is critical that defense attorneys in drug cases stay current on these sentencing issues as well as all recent developments in cases concerning the Fourth Amendment.
